Data controller and reference legislation
The data controller is FABRIC Integrated Architecture, hereinafter “FABRIC”, for brevity. FABRIC processes personal data in compliance with the European legislation on the Protection of Personal Data (hereinafter “GDPR”, for brevity). Pursuant to articles 12, 13 and 14 of the GDPR, the Data Controller provides this information on the processing of personal data carried out by it.
Scope
This disclosure applies to FABRIC and its website and to personal data relating to natural persons. FABRIC cannot be and is in no way responsible for the treatment of independent third parties and third party sites that can be reached from any links on the FABRIC site.
Purpose of the treatments without explicit consent
All personal information that you provide to me without explicit consent, via web or email or otherwise, is optional and the result of your free choice. This information will be processed solely by FABRIC for the purposes of: (a) responding to and satisfying your requests, (b) fulfilling my contractual obligations, (c) pursuing the legitimate interests of the Data Controller [example: defending oneself in court], (d) fulfill legal and tax obligations.
Purpose of the treatments with explicit consent
Only upon express consent from the interested party, FABRIC will process personal data of natural persons for promotional and commercial purposes: for example, to inform you of new product or service offers.
Personal data retention
FABRIC will keep your personal information for the time that is strictly necessary and sufficient for the stated purposes or provided by legal and fiscal regulations or until you request them to be deleted (see also Data Subject’s rights).
Data Subject’s rights
You are a “data subject” if FABRIC processes as data controller any information relating to you as a identified or identifiable natural person. As a data subject you have the following rights:
- to withdraw your consent to processing of your personal data for marketing or commercial purposes* ,
- to ask FABRIC about the existence of personal data about you and to access them,
- to obtain from FABRIC the rectification of any inaccurate personal data about you,
- to obtain from FABRIC the erasure of your personal data** ,
- to lodge a complaint with the supervisory authority.
* that will not affect the lawfulness of processing based on consent before its withdrawal
** your request will be fulfilled, unless there are legal grounds for retaining such data (such as; honor a contract, fiscal obligations,…)
Categories of personal data
Unless otherwise freely provided by the interested party, FABRIC only processes “common” personal data. The systematic and continuous processing of “particular data” (i.e. sensitive, medical, judicial, etc.) is excluded.
Sources of personal data
FABRIC may receive your personal data from yourself by your free choice (via email, website, telephone, fax, etc.) or from public sources (public registers, social networks, etc.). Whatever the source, FABRIC will not process the personal data of natural persons for promotional or commercial purposes without their explicit consent.
